To ask the Secretary of State for Education and Skills if he will issue guidance that pupils with emotional and behavioural difficulties should not be sent to moderate learning difficulties special schools. [189049]

The Special Educational Needs Code of Practice gives guidance to local education authorities on carrying out their statutory duties for identifying, assessing and making provision for children with special educational needs, including those who have behaviour, social and emotional needs. The Code of Practice makes clear that local education authorities must make decisions about the placement of children with statements of SEN on an individual basis, taking account of parental preference.
