§ Further to the Written Answer by the Lord Filkin on 7 June (WA 12–13), whether the rights contained in the European Convention on Human Rights are individual or group rights. [HL3435]
§ The Parliamentary Under-Secretary of State, Department for Constitutional Affairs (Lord Filkin): The convention rights set out in Schedule 1 to the Human Rights Act 1998 apply to all legal and natural persons within the United Kingdom. In order to bring proceedings against a public authority for an action or actions which are rendered unlawful by Section 6(1) of the Act or to rely on convention rights in any legal proceedings, the complainant must be (or would be) the victim of the alleged unlawful act.
