To ask the Secretary of State for the Home Department what definition he will use of the term reasonable explanation for failing to produce documents; and whether he intends to include a definition in relevant legislation. [143473]

Ultimately it will be for the courts to define what constitutes a reasonable excuse for the purpose of the offence set out in clause 2 of the Asylum and Immigration (Treatment of claimants etc) Bill. However, the offence explicitly rules out certain defences which are not to be considered as reasonable causes for no longer being in possession of a document. The defence does not include reference to other legislation.
