To ask the Secretary of State for Health whether NHS foundation trusts will be required to accept vicarious liability for the actions of all their employees for the purposes of insurance. [116839]

Mr. Hutton

It is a well-established common law principle that employers are vicariously liable for the actions of their employees, when acting in their capacity as employees. This principle will apply to national health service foundation trusts.
