Further to the Written Answer by Lord Bassam of Brighton on 7 February (WA 63), whether they are aware of the judgment of the European Court of Human Rights in the Belgian Linguistic Case (No. 2) (merits) (1986) indicating that, although the European Convention on Human Rights does not confer a right to a certain sort of trial, where a state goes beyond its obligations under Article 6 in providing a certain sort of trial, it must do so without discrimination by virture of Article 6 read in conjunction with Article 14. Yes. As indicated in the Answer given to the noble Lord on 7 February,Official Report, WA 63, the Government are determined to ensure that criminal justice legislation does not discriminate on the grounds of race of ethnic origin.
