Specified exports of technology, including designs, are subject to control under various entries in the Export of Goods (Control) Order 1994, the Dual-Use and Related Goods (Export Control) Regulations 1996, and Council Decision 94/942/CFSP, and the controls apply irrespective of whether or not the technology is linked to the provision of training on its use or implementation.

At present, as noted in the White Paper on Strategic Export Controls, published in July 1998, HMG can control only tangible exports, which means that export licences are currently required for controlled technology only when this is exported in physical form e.g. on paper or computer disc. However, the White Paper contained a proposal to provide HMG with the power to control the transfer of technology, whatever the means of transfer, and proposals for the use of that power.
