To ask the Secretary of State for the Home Department if legislation currently being discussed by the Council of Ministers on electronic intercepts is consistent with the 1981 Council of Europe Convention on the Protection of Individuals with Regard to Automatic Processing of Personal Data; and if he will make a statement. The draft Convention on Mutual Legal Assistance in Criminal Matters between the member states of the European Union would, if agreed, be implemented in United Kingdom law in accordance with data protection legislation. The 1981 Council of Europe Convention was implemented in United Kingdom law by the Data Protection Act 1984.
