To ask the Secretary of State for Defence if he will publish the rules relating to the employment of sub-contractors at his Department's establishments under contracts with Building and Property Group Ltd. [80094]

[holding answer 13 April 1999]: The Contractor shall not sub-let any or part of the Contract without the prior consent of the Project Manager. The Contractor is required to include in the sub-contractor's contract statutory obligations imposed on him by the Authority, relating, for example, to Corruption, Secrecy and any other provisions as may be necessary to enable the Contractor to fulfil his obligations under the Contract.

Within the MOD Works Services Manager (WSM) and Establishment Works Consultant (EWC) contracts, there is a requirement on the contractor to provide a list of Companies/Consultants whom they intend to invite to tender, for any works in excess of £5,000. If he intends to invite a subsidiary or associated firm then this must be in addition to three other companies. Acceptance and award of contract should be to the lowest compliant tender.
