To ask the Secretary of State for the Environment, Transport and the Regions if he will exercise his powers under the Level Crossing Act 1983, as amended by the Level Crossing Regulations 1997, to instruct ScotRail to install an automatic open crossing which is locally monitored on the rail crossing at Rovie, Rogart in Sutherland. The Secretary of State has received an application from Railtrack for an Order under the Level Crossing Act 1983 to authorise the most appropriate safety measures for the level crossing at Rovie.

The Department is now seeking the advice of the Health and Safety Executive (HSE) on the safety issues at Rovie Crossing. We expect to receive HSE's advice around the middle of August. The Secretary of State will then take a decision on Railtrack's application. Any new safety measures will be for Railtrack Scotland (not ScotRail) to install.
