To ask the Secretary of State for Wales if under the proposed food standards legislation, the Welsh Assembly will have the powers to ban(a) irradiated foodstuffs and (b) food using genetically modified organisms from sale in Wales. [69592]

Mr. Jon Owen Jones

The Welsh Assembly will have powers over food safety in Wales and will therefore have powers to make and amend secondary legislation relating to irradiated and genetically modified food. The Assembly's actions in respect of food safety will be subject to any obligations imposed upon the UK by EC legislation.
