HC Deb 16 March 1998 vol 308 c509W
Dr. Whitehead

To ask the Secretary of State for the Home Department what representations he has received on the calling of local authority by-elections following the death of the sitting member with particular reference to the sensibilities of those bereaved; and if he will make a statement. [33998]

Mr. George Howarth

None. If the death of a councillor occurs not less than six months before the office concerned would normally have become vacant, a by-election must be held within 35 days of the receipt by the proper officer of the council of a notice of vacancy in writing signed by two electors.
