To ask the Secretary of State for Health what guidance he has given to health authorities on the circumstances in which they can make ex-gratia payments to patients whose health has suffered as a result of medical treatment; and if health authorities are entitled to make such payments to women who have suffered permanent injury after having been in receipt of radiotherapy treatment for breast cancer. Specific guidance on clinical negligence claims handling has been issued by the National Health Service Executive in Executive Letter (96) 11, copies of which have been placed in the Library.

Health authorities may make ex-gratia payments in accordance with this guidance.
