asked Her Majesty's Government:

Further to the Answer given by Baroness Blatch on 18th July 1996 (WA 70), what were their reasons for amending the instructions issued to the enforcement staff of the Immigration and Nationality Directorate so as to remove references to Article 8 of the European Convention on Human Rights from the new version.

The reference in the previous guidance (DP/2/93) to Article 8 of the European Convention on Human Rights proved not to be an accurate reflection of the requirements of the convention in this area.
