To ask the Parliamentary Secretary, Lord Chancellor's Department what was the total cost of the external legal advice received by his Department in relation to transfers of civilian enforcement staff from the police to magistrates courts committees; and when and in what form the contents of that advice will be made available to magistrates courts committees. No external legal advice has been obtained relating to the transfer of civilian enforcement staff from the police to magistrates courts committees. MCCs were again reminded in circular MCD(96)1 on 3 April that whether the Transfer of Undertakings (Protection of Employment) Regulations 1981 apply in a particular situation depends on the facts of the case. Each MCC must determine for itself whether, given its particular circumstances, TUPE will apply, and obtain its own legal advice if necessary.
