To ask the Secretary of State for Transport what plans he has, following the Smith and Kellyv. Wirral metropolitan borough council decision, for re-instating the rights of courts to override the refusal of councils to grant hackney carriage licences. [31351]

As I do not share the hon. Member's view of the implication of this decision, I have no plans of the sort he suggests.
