To ask the Secretary of State for Transport if it is his policy to put in place regulations to ensure that train drivers are given adequate warning of workers on or near the track in a similar way to which prior warning is given to motorists approaching roadworks. [38535]

Mr. Watts

I have no plans to make new regulations for the giving of warnings to train drivers. Railway operators are already required by the Health and Safety at Work, etc. Act 1974 to ensure the safety of their employees and others who might be affected by their undertakings, so far as is reasonably practicable.

Guidance on securing safety on the track and meeting the legal obligations has been published by the Health and Safety Commission's Railway Industry Advisory Committee.
