To ask the Secretary of State for Transport how much compensation has been paid by train operating companies to passengers for delays attributable to Railtrack since introduction of the track access performance monitoring regime. [24550]

Mr. Watts

The track access performance regime sets out compensation arrangements between Railtrack and train operators. It is not concerned with payments to passengers for late trains, which are made under operators' passenger charters.

Live running of the track access performance regime started on 10 December 1995.

Ms Short

To ask the Secretary of State for Transport what amount in supplementary track access charges has been paid by train operating companies and freight operating companies to cover the cost of compensation under the track access performance monitoring regime. [24551]

Mr. Watts

In 1995–96, passenger TOCs paid to Railtrack a supplementary access charge of £75 million. This charge was agreed between BR and Railtrack following a consultation exercise by the Rail Regulator.
