§ Mr. FoulkesTo ask the Secretary of State for Scotland what factors led the Lord Advocate not to pursue the prosecution of Antanas Gecas. [25621]
§ Lord James Douglas-HamiltonIt is not the normal practice of my noble and learned Friend the Lord Advocate to disclose the names of individuals who may have been under investigation. Allegations that persons living in Scotland were responsible for war crimes committed during the second world war were investigated by a specialised Crown Office unit formed in 1991. The results of those investigations were reported to Crown counsel, who decided in 1994 that there was not at that time sufficient available evidence for a criminal prosecution in any of the cases reported to it. That remains the position.
