§ Mr. FraserTo ask the Secretary of State for the Home Department how many applications have been made in the last year by the immigration department for leave to appeal against a decision of an immigration adjudicator; in how many cases leave has been given; and in what percentage of cases where leave has been given the subsequent appeal by the Home Office was successful.
§ Mr. Nicholas BakerAccording to the records of the immigration appellate authorities, in 1994 the Home Office made 691 applications for leave to appeal against adjudicators' determinations; leave was granted in 195 cases. It is not possible to give the percentage of cases where the subsequent appeal was successful because the appeal has yet to be heard in some of the cases in which leave was granted in 1994. Of the Home Office appeals which came before the Immigration Appeal Tribunal in 1994, 113 were successful.
