To ask the Secretary of State for Scotland what considerations he takes into account when determining whether charges of culpable homicide should be proceeded with in relation to drivers of motor vehicles.

Crown counsel will charge a motorist with culpable homicide where, on the evidence available to them, the driver's conduct showed gross or wicked criminal negligence amounting to a criminal indifference to the consequences of his driving.
