§ Mr. MatesTo ask the Secretary of State for the Home Department if discretionary life prisoners who have been transferred to hospital under the Mental Health Act 1983, and whom it is not appropriate to remit to prison even though they no longer require, or can effectively be given, hospital treatment, are able to have the question of their release considered by the Parole Board under section 34 of the Criminal Justice Act 1991.
§ Mr. HowardThe cases of discretionary life prisoners in this category are referred to the Parole Board under section 34 of the 1991 Act, while they remain in hospital, in the same way as if they had been remitted to prison.
