To ask the Secretary of State for the Home Department what action he proposes to take in response to recommendation 1245 of 1994 of the parliamentary assembly of the Council of Europe relating to detention pending trial; and if he will make a statement.

Mr. Maclean

The decision to detain a person pending trial is taken primarily to protect the public and ensure the pursuance of justice.

The majority of the guidelines contained in this recommendation reflect existing law and procedure in the United Kingdom.
