§ By what methods they ensure that persons detained under the Immigration Acts know that they can apply for bail and, if necessary, for a writ of habeas corpus.
The Minister of State, Home Office (Earl Ferrers)While notice in writing is not given in every case, instructions to the Immigration Service require that all those with the right to apply for bail are advised of this. Chief immigration officers also have the authority to grant bail in most circumstances and are required to consider doing so, 'although this procedure is not notified separately. Detainees are not advised that they can apply for a writ of habeas corpus. This would be a matter for their legal representatives to consider in making any application to the courts.
