§ Mr. YeoMeasures to reduce fly tipping are included in the Control of Pollution (Amendment) Act 1989 and the Environmental Protection Act 1990. Under provisions which came into force on 1 April 1992, there is a duty of care on all holders of waste (except private households) to prevent the illegal disposal of their waste. Under the duty, waste may only be handed to an authorised person and transfers of waste must be documented. Carriers of waste must be registered with their waste disposal authority and authorities have powers to seize identified vehicles used in fly tipping. The Environmental Protection Act also includes a provision placing responsibility on the person controlling a vehicle for fly-tipping offences using that vehicle. This latter measure is to be implemented this year; the Government have no plans for further measures at present.
