To ask the Secretary of State for Wales if he will ensure in considering the application for the setting up of the Derwen NHS trust that there will be a facility for the treatment of the in-patient adolescent mentally ill in a unit other than that occupied by adults.

Patient care services provided by NHS trusts must respond directly to the priorities set by commissioners of health care who remain responsible for identifying local health needs and then arranging for those needs to be met.

The sponsors of the trust application have initiated discussions on how best to deliver in-patient services for the adolescent mentally ill separate from that for adults.

The decision whether to establish the Derwen NHS trust will take account of the representations received during the public consultation period, alongside the individual merits of the application.

To ask the Secretary of State for Wales if he will make a statement on the rationale underlying the decisions in respect of whether to guarantee Whitley Council terms and conditions to(a) the Derwen NHS Trust staff or (b) the west Wales ambulance service NHS Trust staff.

The NHS and Community Care Act 1990 provides that staff transferring from health authority to trust employment retain all their contractual and related rights on transfer. Such staff will continue to be subject to nationally negotiated agreements unless they negotiate contracts which exclude them.
