To ask the Secretary of State for the Home Department if he will make a statement on the application of bail and appeal procedures to breach of the peace.

A person ordered to enter into a recognizance to keep the peace may appeal to the crown court under section 1 of the Magistrates' Court (Appeals from Binding-over Orders) Act 1956. Alternatively, he or she may appeal on a point of law by way of case-stated from either a magistrates court or the Crown court, to the High Court. If the person is in custody for refusing to be bound over, the magistrates court or the Crown court, as the case may be, may grant bail pending appeal under section 113 of the Magistrates' Courts Act 1980 or section 81 of the Supreme Court Act, or in either case, the High Court may do so.
