To ask the Secretary of State for Education if he will make it his policy to amend section 2 of the Education Act 1981 to place the onus upon local education authorities to justify segregation of special needs education pupils away from mainstream schools.

The Education Bill currently before Parliament will put a qualified duty on LEAs to integrate children with statements in ordinary schools unless that duty is incompatible with the wishes of the parent. The Bill will also establish an independent special educational needs tribunal. LEAs will be required to justify their decisions over a child's placement on an appeal by the parent to the tribunal.
