asked Her Majesty's Government:

Further to the Answer of the Lord Chancellor on 4th November 1993 in H. L. Deb. col. WA134, whether under Section 138(3) of the Supreme Court Act 1981 it is the duty of the sheriff on receipt of the writ to endorse on the back the hour, day, month and year when he received it; and, furthermore, under Section 138(1), to take it so endorsed with him when he goes to levy execution on the goods of the execution debtor.

The practice to be followed on the execution of a writ offieri facias or other writ of execution against goods issued from the High Court is set out in legislation and case law, including Section 138 of the Supreme Court Act 1981. The precise meaning of such legislation is for the courts to determine.
