Transfer of Undertakings and Acquired Rights

To ask the Secretary of State for the Environment if he will list the advice he has issued to local authorities over the transfer of undertakings and acquired rights directive.

The Directive was implemented in the United Kingdom by the Transfer of Undertakings (Protection of Employment) Regulations 1981. We are at present consulting interested parties on a draft of guidance to be issued under section 9 of the Local Government Act 1992, which states our view that it would be most unusual for the Regulations to apply to a normal contract let under the compulsory competitive tendering legislation. However the interpretation of the law in individual cases is a matter for the courts.
