To ask the Secretary of State for the Home Department (1) what proposals he has to remove the Crown immunity to prosecution in the national health service with respect to fire legislation;

(2) what policy considerations underlie the continuation of Crown immunity for the national health service with respect to fire legislation.

National Health Service premises are already subject to the provisions of the Fire Precautions Act 1971. The Crown immunity which they formerly enjoyed was removed on 1 April 1991 by section 60 of the National Health Service and Community Care Act 1990.
