The enforcement of food labelling regulations, including those relating to the date marking of foods, is the responsibility of individuala local authorities.
The requirement to apply use-by date marks was introduced on 1 January 1991. There would have been no prosecutions for the sale of food after the date shown in a use-by date before 1 January 1991.
