§ Mr. Austin-WalkerTo ask the Attorney-General if he will make a statement on the evidence submitted to the Crown prosecution service following the search of the British National party premises in Welling in January.
The Attorney-GeneralA police report was submitted to the Crown prosecution service following the execution of a search warrant on 9 January 1992 at premises at 154 Upper Wickham lane, Welling in Kent.
Having given careful consideration to this report and taken the advice of Treasury Counsel, the Crown prosecution service decided not to initiate proceedings, on the basis that the available evidence was not such as to give rise to a realistic prospect of conviction for offences contrary to part III of the Public Order Act 1986.
I have also considered this matter and have concluded that the decision by the Crown prosecution service is entirely justified.
