asked Her Majesty's Government:

Whether the provisions of Section 46 of the Criminal Justice Act 1991 (persons liable to removal from the United Kingdom) will apply to existing prisoners as well as to those sentenced on or after 1st October 1992.

Section 46 applies to prisoners who are sentenced before 1st October 1992 as well as to those sentenced after the 1991 Act comes into operation. The arrangements for reviewing such cases are under consideration.
