To ask the Chancellor of the Exchequer if he will publish a timetable showing when he plans to market test those activities listed for testing before 30 September 1993.

Mr. Portillo

[holding answer 9 December 1992]: "Citizen's Charter, First Report: 1992" (Cm 2101) lists the nine Treasury services to be market tested in 1992–93. These are the library, stationery, reprographics, training, economic model building, consultancy inspections services division, recruitment, internal audit and the Treasury security guard (subject to a review). The timetable for completing the market testing exercise for all nine services, as set out in Cm 2101, is September 1993: not all the services will however be tested simultaneously. A start has already been made on testing the first four listed; the intention is to have completed these by spring 1993.

To ask the Chancellor of the Exchequer to which of those of his Department's activities due to be market tested by 30 September 1993, the Transfer of Undertakings (Protection of Employment) Regulations 1981 and the EC acquired rights directive 77/189/EEC will apply.

[holding answer 9 December 1992]: The application of the Transfer of Undertakings (Protection of Employment) Regulations 1981 (TUPE) and the EC Acquired Rights Directive 77/189/ECC has to be determined in the light of the individual circumstances surrounding each of the services to be market tested. The Treasury is currently considering, in consultation with the Treasury Solicitor's Department, those services in its 1992–93 market testing programmes to which TUPE will apply.
