To ask the Secretary of State for the Environment what guidance he gives to local authorities that consider planning applications on land which they are themselves marketing and selling to private developers.

The Town and Country Planning Act 1990 provides that when determining proposals for development of its own land a local authority is bound by the same statutory rules which apply to the determination of any other planning application. It must have regard to the provisions of the development plan, where relevant, and to any other material considerations. The ownership of the land concerned is not a material consideration.
