asked Her Majesty's Government:

Further to the second Answer of the Baroness Blatch on 12th June (WA 63), whether the proposed order on the true construction of Article 4(2) and 4(3) does not apply to lands or funds vested in the Official Custodian for Charities and therefore does not apply to Barkestone School.

The property and funds of any foundation vested immediately before the operative date of the order in the Official Custodian for Charities are expressly excluded from the provisions of Article 4(2) and 4(3) but they are not excluded from the order as a whole. Assets vested in the Official Custodian for Charities are not precluded from being incorporated in an order under Section 2 of the Education Act 1973.
