Mr. Conway

To ask the Secretary of State for the Home Department what is the definition of low and high risk bailees; and what information sources magistrates have available to them in order to decide whether or not to remand in custody or on bail.

Mr. John Patten

There is no such definition. Relevant information is provided to magistrates by the Crown prosecutor and the defendant or a legal representative. Magistrates may also call for information from court duty probation officers, police officers, sureties and others.
