§ Mr. SpellerTo ask the Secretary of State for Transport what steps he will take to ensure that the Federal Republic of Germany conforms with articles 76 and 95 of the European Community treaty by not imposing additional taxes on heavy goods vehicles.
§ Mr. AtkinsThe EC Commission announced on 10 April that it would serve on the German Government a letter under the procedure laid down in article 169 of the EC treaty. It is understood it will state that the Commission considers the Federal Republic of Germany has failed to fulfil its obligations under articles 5, 76 and 95, and is the first step in a process leading to the European Court of Justice. The United Kingdom strongly supports this action.
