To ask the Secretary of State for Social Security if he will bring forward legislation to ensure that a spouse remaining at home can continue to have a share of the occupational pension of someone admitted to permanent residential or nursing home care who is in receipt of income support.

No. An individual who enters permanent residential or nursing home care remains entitled to an occupational pension. Whether part of a member's pension may be commuted to provide pension for a spouse is a matter for determination in accordance with the rules of the scheme.
