asked Her Majesty's Government:

Whether in the light of recent cases they consider that magistrates receive adequate guidance as to the appropriate penalties for drink-driving offences, particularly for second convictions.

Sentencing is a matter for the courts within their overall powers as laid down by legislation and in accordance with guidance given by the Court of Appeal. I understand that the Magistrates' Association are considering the issue of new guidelines on road traffic sentencing to their members.
