Mr. Mullin

To ask the Secretary of State for the Home Department what criteria he uses in judging whether a case is sub judice for the purpose of answering parliamentary questions.

Mr. Hurd

It is not for Ministers to decide whether a case is sub judice in the strict sense which, under the rules of the House, precludes reference to it in a question. Our responsibility is for the answer to be given, and it is not our practice to comment on matters which are in a wider sense awaiting or under adjudication by a court.
