§ Mr. HayesTo ask the Attorney-General if he will introduce new regulations for the distribution of intestacy proceeds from the Bona Vacantia Department to pass to charities in untraceable cases.
§ Mr. BrookeI have been asked to reply.
No. The Treasury Solicitor is already authorised by the Treasury to make payments from Bona Vacantia to those for whom a person dying intestate might reasonablly have been expected to provide. A charity will therefore benefit from an estate where it has helped the deceased, or where it is clear that the deceased intended it to benefit. There is no intention to extend these principles to benefit charities in any other circumstances.
