To ask the Secretary of State for Social Services whether he will consider taking steps to amend the Supplementary Benefit (Conditions of Entitlement) Regulation 6(b) to insert a specific reference to receipt of the invalid care allowance being an acceptable reason to exempt a person from the requirement to register and be available for employment in order to receive supplementary benefit.

At the moment a person receiving invalid care allowance is usually exempt from the requirement to be available for work under the provisions of Supplementary Benefits (Conditions of Entitlement) Regulation 6(b) which applies where there are no alternative means of caring for a disabled person in receipt of attendance allowance. From the start of the income support scheme in April next year there will be a specific exemption for persons in receipt of invalid care allowance by virtue of paragraph 4(a) of schedule 1 to the draft Income Support (General) Regulations.
