asked the Secretary of State for Social Services what is his policy regarding misconduct as it relates to the dismissal of community health council members under regulations which will become effective on 1 April.

Under the new Community Health Council Regulations it will be for each regional health authority to determine, in the light of views sought from the appointing body and the community health council itself, whether the personal or professional misconduct of a CHC member renders him unfit to be a member and therefore justifies dismissal. The provision was introduced following criticism in the courts of its absence from earlier regulations. Copies of the National Health Service (Community Health Council) Regulations 1985 and the explanatory circular HC(85)11 are in the Library.
