39. Mr. David Marshall

asked the Secretary of State for Foreign and Commonwealth Affairs if he will seek to ensure that Spain signs the nuclear non-proliferation treaty prior to joining the European Community.

Mr. Luce

We have consistently made clear to the Spanish Government our hope that they will accede to the nuclear non-proliferation treaty. Accession is not, however, a requirement of Community membership. There is no basis in Community law for insisting that Spain becomes party to the treaty. Spain's acceptance of full-scope safeguards will fulfil Euratom requirements.
