§ 15. Mr. Martin
asked the Secretary of State for Scotland if he will introduce legislation to provide that, in cases where persons are convicted in Scotland of drug dealing, their personal assets may be ordered by the court to be forfeited.
§ Mr. Ancram
We are considering very carefully how, best to provide in Scotland for the confiscation of the 227W proceeds of drug offences, having regard to the recommendations of the Hodgson committee. While drug dealers in particular should not be allowed to profit from their crimes, the forfeiture of personal assets raises complex questions of law, which have to be fully considered.
