HC Deb 12 May 1983 vol 42 c465W
Mr. McKelvey

asked the Secretary of State for the Environment how many times the compulsory purchase powers in section 91 of the Local Government Planning and Land Act 1980 have been used to acquire land.

Mr. Giles Shaw

Section 91 substituted new subsections for section 112(1) of the Town and Country Planning Act 1971, which dealt with compulsory acquisition by local authorities of land for development and allied purposes. The new subsections came into force on 13 November 1980.

Between 1 January 1981 and 31 March 1983 my right hon. Friend the Secretary of State decided 147 orders—126 confirmed, 21 rejected; a further 23 orders were withdrawn before the decisions were taken. I understand that in the same period my right hon. Friend the Secretary of State for Wales confirmed six orders and rejected one; two others were withdrawn. Some of these orders would have been submitted under the former section 112 before the section 91 amendments took effect.

Information on how many of the confirmed orders have been used is not readily available.
