asked her Majesty's Government:

Whether, having regard to the complexity of Sections 76 and 77 of the Administration of Justice Act 1982 (c. 53), they will specify—

  1. (i) which parts of the Act extend to Scotland and are in operation;
  2. (ii) which parts of the Act extend to Scotland but are not in operation; and
  3. (iii) when those parts extending to Scotland but not now in operation are likely to be brought into operation.

Of the substantive provisions of the Administratin of Justice Act 1982 which extend to Scotland, Sections 7 to 11 inclusive, 13, 14(1), (3) and (4) and 26 came into operation on 1st January 1983. Sections 12, 14(2), 23 to 25 inclusive, 27, 28, Sections 40 and 41 as applied to Scotland by Section 48, and Section 75 so far as it relates to the Damages (Scotland) Act 1976, are not yet in operation. Commencement of these provisions is in general contingent upon the preparation of appropriate procedural rules and it is not possible to estimate when it may be possible to bring them into operation.
