§ Mr. Wiggin:No. The provisions of section 10 of the Crown Proceedings Act 1947 apply in this case, and the Ministry of Defence is not legally liable for any common law claim made by the late Mr. Cosgrove or his family. A war pension at the 100 per cent. rate was awarded by the Department of Health and Social Security to Mr. Cosgrove with effect from 13 January 1982.
