Mr. Jim Spicer

asked the Secretary of State for the Environment whether the determinations outstanding at the date of commencement of section 55 of the Wildlife and Countryside Act 1981 will continue to be dealt with by his Department under the procedures of the Countryside Act 1968; and if he will ensure that those determinations will be given effect whatever the fate of the relevant survey or review.

Mr. Macfarlane:

Section 55 allows for the completion or abandonment of a survey or review. Where a survey or review is abandoned that abandonment will be conditional on the determination by my right hon. Friend the Secretary of State of objections and representations for which inquiries have been held or arranged at the date of abandonment. All such decisions are required by the Act to be given effect.
